The National Coalition to Stop the Gun Ban

New Mexico Gun Owners Association has joined the National Coalition to Stop the Gun Ban.

A national coalition of grassroots, pro right to keep and bear arms organizations has formed to defeat gun bans, magazine capacity limits, attempts at registration and other gun control measures in the upcoming session of Congress.

Grassroots supporters of the right to keep and bear arms have drawn a “line in the sand” that any person in Congress or any bureaucrat with hopes of future political office or appointment had better be aware of.  Crossing the gun control line will bring an entirely new and highly motivated contingent of the “gun lobby” to bear.  Gun prohibitionists have nobody to blame but themselves with wild eyed threats of confiscation, police raids, forced buybacks, mandatory registration and a litany of other threats.  The gun lobby takes these threats very seriously and as the news media are finding out, gun lobbyists know how to use social media too.  The latest batch of papers releasing interactive maps of known gun owners got a dose of their own medicine when their details were published with an interactive map.

Make no mistake, this is not a “national discussion” about guns or talk of addressing the causes of violence or solutions to it.  This latest feeding frenzy of calls for gun control are a political declaration of war.  As the gun prohibitionists have repeatedly demonstrated, they will do absolutely anything with a complete lack of shame, class or honor.  This should not be lost on the gun lobby.

Understand, that in this political war, there are no honorable mentions, no points for doing well, and second place is first loser.  In this political war there is only victory or defeat.

State Gun Control?

As of right now, there are NO gun bills that have been prefiled for this session.

Representative Miguel Garcia is planning to introduce a bill that would require background checks on all transfers of firearms including private sales and transfers.

NM Gun Owners Association is against this bill and we will be encouraging all of our members to be sure to write your state legislators and let them know how you feel.  We will be sending a letter to each of the representatives which will be hand delivered to them during this session.  We will make this letter available as soon as the bill is filed so that we can be complete and relevant in our position and arguments.

The public may use portions of this letter or the letter in its entirety to notify their legislators if they would like.

2013 Legislative Session Plan

There are now two gun bills in the NM House of Representatives.

Rep. Miguel Garcia (D-ABQ) has now introduced House Bill 77!

HB 77 restricts ALL private transfers of firearms – not just those taking place at gun shows – including those between family members, friends and co-workers. Any person who is not a federal firearms licensed dealer (FFL) would have to contact the New Mexico Department of Public Safety prior to transferring any firearm to any prospective purchaser, provide the department detailed information on the firearm being sold and the person to whom the firearm is being transferred, and get approval from the department before the transfer is completed. This includes transfers between relatives, friends and co-workers. In order to accomplish this, the bill sets up a state-level criminal records check system, which will be paid for by lawful gun buyers.

HB 77 establishes a $25.00 fee on private gun transfers – $35.00 if the transaction occurs at a gun show – amounting to a tax on gun purchases. Lawful gun buyers shouldn’t be forced to pay for a system that’s being created under the guise of public safety – all taxpayers should bear the brunt of this cost. The FBI-run National Instant Check System which FFLs use imposes no "user fee" on prospective gun buyers.

HB 77 creates a state registry of legal firearms transferees and purchasers. Private sellers would be required to provide the department the name, address, and telephone number of the purchaser; the make, model, caliber, and serial number of the firearm being transferred; and the name, date of birth, race, sex and address of the buyer. DPS is required to retain a record of this information for five years. Under NICS, FBI is required to destroy all records of approved purchasers by the next business day.

HB 77 imposes record keeping requirements on private sellers, requiring them to maintain records of approved transfers for five years, and it contains no privacy protections to prevent (or detect) a person using the system to run a background check on someone for purposes other than a gun purchase.

The measure has been referred to two committees - House Judiciary and House Appropriations, and it could soon be set for a public hearing in the first committee. Please check back here for updates on scheduled action on this measure. In the meantime, it is critical that you contact committee members, as well as your own State Representatives, and urge them to OPPOSE HB 77!

The next one is HB 114.  It is basically a firearms freedom act and NMGOA supports this bill, although it could be better.  It is a HUGE step in the right direction.
